Student Agreement

This agreement seeks to welcome you as a driver training student with XDT Driving Instructors. We are delighted you chose to join us and wish you all the best in your training. Our goal is for you to not just pass your test but to enjoy your time and learn to be street smart, think ahead, and prepared to drive on your own after successfully passing the driving test.

The following terms and conditions represent the basis upon which driving lessons and driver training is offered by XDT Driving Instructors. By booking a lesson with an X Driver Tester, you acknowledge these terms.

Your Instructor and You

Your X Driver Tester Driving Instructor is an independent contractor operating under their own registered ABN. Your agreement to teach is between you and your instructor. XDT Driving Instructors provides services for your instructor to book lessons, receive online payments, and use the XDT Driving Instructor name.

All instructors are bound by a professional code of conduct.

  • Your instructor will be courteous, polite, tidy and punctual.
  • He or she will always behave in a professional and ethical manner at all times.
  • Your training vehicle will be well maintained, clean and tidy and registered within the Australian state or territory Department of Transport that lessons are provided in.
  • Standard equipment includes dual controls and additional mirrors.
  • At all times your instructor will fully comply with all applicable Road Law and Regulations.
  • He or she will be a licenced driving instructor within the Australian state or territory Department of Transport that lessons are provided in and hold a valid working with children permit.
  • Your instructor will carry the appropriate motor and liability insurance, should you be involved in a collision as a learner driver while in control of driving the instructor’s vehicle.

Complaints

In the rare event of any problem arising during your driver training, you should attempt to resolve this with your instructor. In the event that you are unable to reach a satisfactory conclusion, or feel uncomfortable discussing the issue, we will be happy to investigate further until the matter is resolved.

Should you for whatever reason not feel comfortable continuing lessons with your instructor you can contact XDT Driving Instructors and we will assign you a new instructor covering your area. We strive to have the highest teaching standards for all our instructors and take any complaints seriously.

At the end of your driver training you may be asked to provide feedback how you experienced your time with us. This will help us in our continuous improvement.

Driving Lesson Availability

Your instructor is free to set his or her own working hours and will advise you of his or her availability. Unless otherwise advised, your instructor will work Monday to Friday from 7 am to 7 pm and Saturdays and Sundays as available.

Driving Licences and Fitness to Drive

To participate in driver training you must hold a current, valid Learner, Provisional, Full or Overseas (International Driving Permit not accepted) Drivers Licence, and produce it at the beginning of all your driving lessons.

You must be fit to drive and not be under the influence of alcohol or drugs (prescribed or otherwise, unless approved by the Australian State or Territory Department of Transport that lessons are provided in and stated as a condition on your licence). You must comply with all the road rules and any instructions directly to you by your driving instructor.

You must not wear footwear which the instructor thinks may cause safety concerns with the foot controls.

Mobile phones must be switched off or turned onto silent during the driving lesson. We do not accept any responsibility for personal property that is left in a vehicle.

Student Payments and Cancellation

Payments for lessons can be made by cash or Card at the lesson, bank transfer/PayPal to your instructor 24 hours before the lesson.

We understand that from time to time you may need to reschedule a lesson time or cancel a lesson. When you book a lesson with XDT Driving Instructors you are securing a professional trainers time and allocated a custom training vehicle for your lesson. We ensure that their resources are allocated solely to you only for the duration of your lesson booking, and as a result there are associated costs with reserving you these resources.

A minimum of 24hrs notice is required in the instance that you need to cancel or reschedule a lesson time or date. Cancellations can be made via telephone, text message or email. If less than 24hrs notice is provided to XDT Driving Instructors or your instructor, the full lesson fee will be charged and payable for the lesson. In the instance of driving tests, we require a minimum of 48 business hours’ notice should you wish to reschedule or cancel the test, else the lesson fee and booking fee will still be payable.

If no cancellation notice is given and a student fails to arrive or show up for a scheduled driving lesson or fails to have a current drivers licence on them, the full lesson fee will be charged and payable for the lesson. We strictly uphold our cancellation, rescheduling and no show policy to ensure our high standards and level of service to each and every student.

Instructor Change or Cancellation of Lesson

Your driving instructor will do everything possible to ensure that your driving lessons start and finish on time. Should your driving instructor be running behind schedule, you will be notified. If the instructor is late to a lesson, they will make a concerted effort to extend the lesson by the time due or credit the time owing to the student’s next driving lesson.

We reserve the right to cancel, postpone or change lesson lengths and start/finish times under certain circumstances (e.g., your driving instructor is sick, dangerous weather conditions, etc.). XDT Driving Instructors will do everything in our power to avoid having to do so, however in the event of postponement, any fees paid will be carried forward to the next driving lesson or refunded upon your request.

The driving instructor reserves the right to cancel a lesson at short notice or throughout the duration of the lesson if the student is suspected to be under the influence of alcohol or drugs, any other condition that would cause the students driving to be dangerous or illegal or does not follow the driving instructors’ direction. In such circumstances, the lesson fee is still payable.

Termination of Agreements and Refunds Policy

Both the student and their instructor have the right to terminate any services agreement for any reason, including the ending of driver training services that are already underway. No refunds shall be offered, where a service (e.g. lesson) is deemed to have begun and is, for all intents and purposes, underway.

Discount packages are not refundable or transferable should you not use all the lessons within the packages.

Driving Training Location

All driving lessons will commence and finish at the same location unless an alternative drop off address has been agreed upon when the original lesson booking was made. Any changes to the pickup and drop off address without at least 24 hrs notice to your instructor may result in part of the lesson duration being forfeited to allow for the extra travel time.

Your instructor will determine suitable streets and locations for practical lessons which ensures the safety of the student, instructor and the general public. This may mean that the instructor may need to drive the customer to and from suitable streets and locations, of which still forms part of the driving lesson duration and time.

Training Vehicles

Driver training vehicles provided by our contracted instructors are roadworthy, comprehensibly insured, registered within the Australian State or Territory Department of Transport that lessons are provided in, and fitted with dual controls.

Our instructors make every effort to ensure that the vehicle supplied for driving tests are fully roadworthy and comply with all the legal requirements at all times, but cannot be held responsible for vehicle failure that occurs in the day prior, the day of and during the driving test and we are not liable for any consequential loss.

Driving Tests

Driving tests will in most circumstances be booked by yourself in collaboration with your instructor and you provide us with the booking ID number for verification and changes if necessary. Without collaboration your instructor may not be available for you to use their vehicle for the test. In those circumstances you are required yourself to ensure you have a suitable vehicle for the test.

Driving test bookings should be made a minimum of one (1) month in advance from the date of booking. Later bookings can be made if there is a free test spot at your licencing centre.

Due to the limited availability of test appointments with the Australian State or Territory Department of Transport, your instructor reserves the right to re-schedule your existing practical driving lessons for other students, where they have booked a practical driving test. Your instructor will provide the same courtesy to you, should the need occur.

Your instructor cannot be held responsible for any test bookings cancelled by the Australian State or Territory Department of Transport.

To acknowledge your driver training success in passing your driving test, XDT Driving Instructors would like to publish your picture on our social media sites. If you wish to have your picture published in this manner please let your instructor know after your test.

We reserve the right to change these conditions from time to time. Your continued use of our services will signify your acceptance of any adjustment to these terms. These terms and conditions form part of the agreement between you as a client and your instructor as an independent contractor for XDT Driving Instructors Pty Ltd. You accessing the XDT Driving Instructors website and/or undertaking of a booking indicates your understanding, agreement to and acceptance, of the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
